INTRODUCTION

These Terms and Conditions (“Terms”) govern your use of the SafeCab mobile application and services (“Service”, “App”) operated by SafeCab (“we”, “us”, or “our”). By accessing or using our Service, you agree to be bound by these Terms.

If you disagree with any part of these Terms, then you may not access the Service. These Terms apply to all visitors, users, drivers, and others who access or use the Service.

DEFINITIONS

  • “User” refers to any person who uses the SafeCab application to request transportation services
  • “Driver” refers to any person who provides transportation services through the SafeCab platform
  • “Service” refers to the SafeCab mobile application and transportation matching platform
  • “Ride” refers to transportation services provided by Drivers to Users through the platform
  • “Platform” refers to SafeCab’s technology platform that connects Users with Drivers

ACCEPTANCE OF TERMS

By creating an account, downloading our app, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and SafeCab.

ELIGIBILITY

To use SafeCab services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Possess a valid payment method
  • Provide accurate and complete registration information
  • Comply with all applicable laws and regulations

For Driver eligibility, additional requirements apply including but not limited to valid driver’s license, vehicle registration, insurance, and background checks.

USER ACCOUNTS

Account Registration

  • You must create an account to use SafeCab services
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate, current, and complete information during registration
  • You are responsible for all activities that occur under your account

Account Security

  • You must immediately notify us of any unauthorized use of your account
  • SafeCab is not liable for any loss or damage arising from unauthorized account access
  • You may not transfer your account to another person without our written consent

SERVICE DESCRIPTION

SafeCab provides a technology platform that connects Users seeking transportation with Drivers willing to provide such services. SafeCab does not provide transportation services directly and is not a transportation carrier.

For Users:

  • Request rides through the mobile application
  • View estimated arrival times and fares
  • Track ride progress in real-time
  • Rate and review Drivers
  • Access ride history and receipts

For Drivers:

  • Receive ride requests from Users
  • Accept or decline ride requests
  • Navigate to pickup and destination locations
  • Receive payment through the platform
  • Rate and review Users

BOOKING AND RIDES

Ride Requests

  • Users can request rides through the mobile application
  • Ride requests are offers to contract with available Drivers
  • SafeCab does not guarantee that a Driver will accept your ride request
  • Estimated arrival times and fares are approximations and may vary

Ride Acceptance

  • Once a Driver accepts your ride request, a binding contract is formed between you and the Driver
  • You agree to be present at the pickup location at the designated time
  • Drivers may cancel rides in accordance with our cancellation policy

Ride Completion

  • Rides are completed when you reach your destination or the trip is otherwise ended
  • You are responsible for checking that you have all personal belongings before exiting the vehicle

PAYMENT TERMS

Fare Calculation

  • Fares are calculated based on time, distance, demand, and other factors
  • Dynamic pricing may apply during periods of high demand
  • Applicable taxes, fees, and surcharges will be added to the base fare

Payment Methods

  • Payment is processed automatically through your selected payment method
  • You authorize SafeCab to charge your payment method for all applicable fees
  • You are responsible for ensuring your payment method is valid and has sufficient funds

Receipts and Billing

  • Electronic receipts will be provided for all completed rides
  • You may dispute charges within 30 days of the transaction
  • Refunds are subject to our refund policy and applicable laws

CANCELLATION POLICY

User Cancellations

  • You may cancel a ride request before a Driver arrives at the pickup location
  • Cancellation fees may apply if you cancel after a Driver has been assigned
  • Repeated cancellations may result in temporary suspension of your account

Driver Cancellations

  • Drivers may cancel rides for safety, vehicle, or other legitimate reasons
  • You will be notified immediately of any Driver cancellation
  • Alternative rides will be suggested when available

RATINGS AND REVIEWS

Rating System

  • Users and Drivers may rate each other after completed rides
  • Ratings help maintain service quality and safety standards
  • Consistently low ratings may result in account suspension or termination

Review Guidelines

  • Reviews must be honest, accurate, and relevant to the ride experience
  • Prohibited content includes discriminatory, offensive, or false statements
  • SafeCab reserves the right to remove inappropriate reviews

SAFETY AND CONDUCT

User Responsibilities

  • Comply with all applicable laws and regulations
  • Treat Drivers with respect and courtesy
  • Do not engage in threatening, abusive, or discriminatory behavior
  • Wear seatbelts and follow safety instructions
  • Do not consume alcohol or illegal substances in vehicles

Driver Responsibilities

  • Maintain a valid driver’s license and vehicle registration
  • Ensure vehicle safety and cleanliness standards
  • Follow traffic laws and safe driving practices
  • Treat Users with respect and courtesy
  • Complete background checks and document verification

Prohibited Activities

  • Using the Service for illegal purposes
  • Harassment, discrimination, or threatening behavior
  • Attempting to circumvent safety measures
  • Fraudulent or deceptive practices
  • Violating intellectual property rights

INTELLECTUAL PROPERTY

SafeCab and its licensors own all intellectual property rights in the Service, including but not limited to:

  • Trademarks, logos, and brand names
  • Software, applications, and technology
  • Content, data, and information
  • Trade secrets and proprietary methods

You may not copy, modify, distribute, or create derivative works without our express written permission.

PRIVACY AND DATA

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to our data practices as described in the Privacy Policy.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • SafeCab is not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim
  • We make no warranties regarding the availability, reliability, or quality of the Service
  • Transportation services are provided by independent Drivers, not SafeCab

INDEMNIFICATION

You agree to indemnify and hold SafeCab harmless from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your conduct in connection with the Service

DISPUTE RESOLUTION

Governing Law

These Terms are governed by the laws of [Your Jurisdiction] without regard to conflict of law principles.

Dispute Process

  • We encourage resolving disputes through direct communication
  • Formal complaints should be submitted through our customer support channels

TERMINATION

Termination by User

You may terminate your account at any time by contacting customer support or using the account deletion feature in the app.

Termination by SafeCab

We may suspend or terminate your account immediately if you:

  • Violate these Terms or our policies
  • Engage in fraudulent or illegal activities
  • Pose a safety risk to other users
  • Provide false or misleading information

Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • Outstanding payments remain due and payable
  • Certain provisions of these Terms survive termination

MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of significant changes through:

  • In-app notifications
  • Email communications
  • Posted notices on our website

Continued use of the Service after changes constitutes acceptance of the modified Terms.

MISCELLANEOUS

Severability

Assignment

You may not assign these Terms without our written consent. SafeCab may assign these Terms at any time without notice.

Force Majeure

SafeCab is not liable for any failure to perform due to circumstances beyond our reasonable control.
